
The Punjab and Haryana High Court has allowed the registration of an FIR against Emaar India in a matter related to a property dispute in Haryana. This gives the green light for the initiation of criminal proceedings against the real estate company.
This decision by the High Court comes on the heels of a litany of petitions related to the delay in the delivery of the projects, the failure to meet the promises made by the developers, and the misconduct by developers in executing the residential complex. In its ruling, the High Court stated that the petitioners’ claims cannot be dismissed at the preliminary stage and must be examined. This gives a green light for the law enforcement agencies to move forward and investigate the claims.
